1. Acceptance of Terms

By accessing and using the DEP Auction Group website (depauctiongroup.com), participating in our auctions, or registering as a bidder, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Bidder Registration and Eligibility

2.1 Registration Requirements

All bidders must register with DEP Auction Group before participating in auctions
You must provide accurate, current, and complete information during registration
You must be at least 18 years of age to participate in our auctions
You are responsible for maintaining the confidentiality of your account credentials

2.2 Account Approval

DEP Auction Group reserves the right to refuse registration or participation to any individual
We may deny access to bidders with negative scores, bad reviews, or history of non-payment
Approved bidders will receive confirmation and bidding access

2.3 Valid Payment Method

A valid payment method must be established with DEP Auction Group to participate in bidding
Payment arrangements may be required prior to auction participation

3. Bidding Process

3.1 How to Bid

Bidding is conducted through DEP Auction Group’s auction platform
Bids are binding commitments to purchase items at the bid amount
Each bid represents an irrevocable offer to purchase the item

3.2 Bid Increments

Bid increments are predetermined and displayed on each auction lot
Bidders must bid in the specified increments

3.3 Maximum Bids and Proxy Bidding

The platform may offer proxy bidding, where the system automatically bids on your behalf up to your maximum bid
You are responsible for all bids placed under your account

3.4 Auction Closing

Auctions may have soft close extensions if bids are placed near closing time
The winning bid is the highest bid placed when the auction closes
All sales are final once the auction closes

4. Payment Terms

4.1 Payment Method

Payment methods accepted include cash, check, credit cards, and other methods as specified by DEP Auction Group
Payment is due immediately upon winning an auction unless other arrangements have been made
Full payment must be received before items can be removed

4.2 Buyer’s Premium

A buyer’s premium of 15% will be added to the final bid amount
Applicable sales taxes will be charged based on your location and item pickup/delivery address

4.3 Non-Payment

Failure to pay for won items may result in:
- Account suspension or termination
- Negative feedback on your bidder profile
- Legal action to collect payment
- Liability for any deficiency if item is resold

5. Shipping and Pickup

5.1 Shipping Options

Shipping is available for most items
Buyers must contact DEP Auction Group for shipping quotes
Shipping costs are the responsibility of the buyer
Items will not be shipped until full payment is received

5.2 Pickup

Items may be picked up during designated times and locations as specified in each auction
Buyers are responsible for bringing adequate help and equipment for item removal
Appointments may be required for pickup

5.3 Risk of Loss

Risk of loss passes to the buyer upon payment or scheduled pickup time, whichever occurs first
DEP Auction Group is not responsible for items after the designated pickup period

6. Item Descriptions and Condition

6.1 “As-Is, Where-Is”

All items are sold “AS-IS, WHERE-IS” with no warranties or guarantees, express or implied
DEP Auction Group makes no representation regarding the condition, functionality, or fitness for any particular purpose

6.2 Inspection

Bidders are encouraged to inspect items prior to bidding when preview is available
Photos and descriptions are provided for convenience but may not show all defects or conditions
Bidders are responsible for determining the condition and suitability of items

6.3 No Returns

All sales are final
No refunds, returns, or exchanges will be accepted
It is the bidder’s responsibility to bid only on items they intend to purchase

7. Seller and Auctioneer Responsibilities

7.1 Auctioneer Rights

DEP Auction Group reserves the right to:
- Cancel or postpone auctions
- Remove or add items to auctions
- Reject any bid that seems fraudulent or suspicious
- Refuse service to any bidder
- Correct errors in listings or pricing

7.2 Title and Ownership

We sell items on behalf of consignors and sellers
We do not warrant title to items sold
Buyers receive whatever title the consignor had to convey

8. Disputes and Arbitration

8.1 Dispute Resolution

Any disputes between buyers, sellers, or the auction company will be resolved under the laws of Idaho
In the event of a dispute regarding a winning bid, the auctioneer’s decision is final

8.2 Governing Law

These Terms and Conditions are governed by the laws of Idaho
Any legal action must be brought in Payette County, Idaho

9. Privacy and Data Protection

9.1 Information Collection

We collect personal information necessary to process transactions
We will not sell your personal information to third parties
Your information is kept confidential and secure

9.2 Communication

By registering, you consent to receive auction notifications, invoices, and promotional emails
You may opt out of promotional communications at any time

10. Prohibited Conduct

Bidders agree not to:

Bid on items without intention to complete the purchase
Use another person’s account without permission
Engage in bid manipulation or shill bidding
Interfere with auction operations
Submit false or misleading information
Violate any applicable laws or regulations

Violation of these terms may result in immediate account termination and legal action.

11. Limitation of Liability

11.1 Disclaimer

DEP Auction Group is not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the purchase price of the item in question

11.2 Platform Availability

We do not guarantee uninterrupted access to our website or auction platform
Technical issues, maintenance, or other problems may affect auction access

12. Intellectual Property

All content on DEP Auction Group websites, including text, graphics, logos, images, and software, is the property of DEP Auction Group or its content suppliers and is protected by copyright and intellectual property laws.

13. Modifications to Terms

DEP Auction Group reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services constitutes acceptance of modified terms.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
